Justin Baldoni maintains the MCU debut of Nicepool. However, as Baldoni's legal team has requested that Marvel Studios cooperate with their request to find out if Nicepool was a commentary on him, things have only gotten more complicated.
In new reports from TMZ and Forbes respectively, new court documents have revealed that Baldoni is doubling down on his claims that Reynolds created the Nicepool character in Deadpool & Wolverine to mock him. On April 25, Marvel Studios sent a letter to New York federal judge Lewis Liman asking the court to shut down Baldoni's request for documents relating to the character, claiming they're irrelevant to Baldoni's claims of defamation. They also cited potential harm to Marvel if the confidential documents entered the public record.
On April 28, Baldoni, through his lawyers, responded to Marvel's move to shut down his request by reaffirming the documents are relevant to his case and pose little harm to the studio since Deadpool & Wolverine has already been released. The actor argues that proving Reynolds intentionally mocked Baldoni through the Nicepool character is important because it would establish malice for his defamation claim. Further, Baldoni's lawyers accused Marvel of "refusing to engage" with Baldoni to resolve the dispute.
What The Marvel And Justin Baldoni Nicepool Update Means
From a larger picture, this latest update about Nicepool will not necessarily be something that hurts Deadpool & Wolverine, given that the movie has had its theatrical run and has already become available through home media. If anything, Nicepool's legacy will now simply be awkward and bizarre, as the world collectively determines on their own whether or not this was a character created for the purpose of mocking Baldoni. There really is no way to remove Nicepool from the Deadpool & Wolverine story, unless he was digitally replaced with another character who serves a similar purpose for the arc.
However, Nicepool adds further complications in the Lively/Baldoni lawsuit, with the latter using the Deadpool & Wolverine movie as evidence of the smear campaign against the Jane the Virgin alum by her husband. If Baldoni's legal team ends up retrieving the documents from Marvel and Disney that prove that Nicepool was indeed a creation to make fun of the actor, it will make the studios look complicit in using Deadpool & Wolverine to humiliate the It Ends with Us actor/director. At the time of this story's publication, Disney and Marvel Studios have yet to address Baldoni's latest response in relation to the documents.

While time will tell if Baldoni and his legal team will get the requested documents about the creation of Nicepool in Deadpool & Wolverine, this new update makes it clear that the lawsuit between him and Lively, following It Ends with Us, is far from over. It will be interesting to see how Marvel Studios and Disney respond to this, following their original move to have Baldoni's request tossed out. But for now, it remains to be seen what really happened with Nicepool and what led to his creation in Deadpool & Wolverine.
